Welcome to Madstream Sp. z o.o. (“MadStream”, “we”, “us”, or “our”). These Terms of Use (“Terms”) govern your access to and use of our streaming services (the “Service”) on Roku, Amazon Fire TV, our website, and any related applications or interfaces (collectively, the “Platform”). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

2. License Grant

Subject to these Terms, MadStream grants you a limited, non-exclusive, non-transferable, revocable license to access and view content on the Platform for your personal, non-commercial use.

• Credentials: You are responsible for safeguarding your login credentials and for all activity under your account.

• Reverse engineer, decompile, or otherwise attempt to extract the source code of the Platform;

• Transmit any viruses, malware, or other harmful code;
• Collect or harvest any personally identifiable information about other users;
• Circumvent any content filtering techniques or access content not intended for you.

5. Content Ownership & Intellectual Property

All content, features, and functionality on the Platform, including text, graphics, logos, images, audio and video clips, and software, are the exclusive property of MadStream or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute our content except as expressly permitted by these Terms or with our prior written consent.

6. Advertising

Our Service features advertising delivered by MadStream and our third-party partners. Your interactions with ads are subject to our Privacy Policy – Advertising. You may see personalized ads if you have given consent; you can withdraw that consent at any time as described in the Privacy Policy.

7. Disclaimers

“AS-IS” – The Service is provided on an “as-is” and “as-available” basis. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant the Service will be uninterrupted, secure, or error-free.

8. Limitation of Liability

To the fullest extent permitted by law, MadStream and its affiliates, officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising from these Terms or the Service will not exceed the amount you paid (if any) to access the Service in the 12 months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless MadStream and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Service or violation of these Terms.

10. Termination

We may terminate or suspend your access to the Service at any time, without notice or liability, for any reason, including breach of these Terms. Upon termination, the license granted in Section 2 will immediately end and you must cease all use of the Service.

11. Changes to Terms

We may revise these Terms at any time. If we make material changes, we will notify you via the Platform or by email (if you have an account). Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

12. Governing Law & Dispute Resolution

These Terms and any disputes arising out of or relating to them or the Service will be governed by Polish law without regard to its conflict-of-law principles. Any legal action or proceeding will be brought exclusively in the courts of Warsaw, Poland, and you consent to personal jurisdiction there.

13. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any documents they expressly incorporate, constitute the entire agreement between you and MadStream regarding the Service.
